Federal Court rules on Housing Allowance case
The General Board of Pension and Health Benefits and the General Council on Finance and Administration of The United Methodist Church have both issued updates explaining that a federal court has ruled to dismiss a case that claimed the clergy housing allowance was unconstitutional.
Last year, a federal district judge in Wisconsin held that Internal Revenue Code Section 107(2) (the clergy housing allowance) was unconstitutional. The government appealed the case to the Seventh Circuit Court of Appeals, who on Nov. 13, 2014 vacated the lower court’s decision, and remanded the case “with instructions to dismiss the complaint for want of jurisdiction.”
"In short, the Seventh Circuit held that the plaintiffs did not have standing to bring the case," explains Steven C. Lambert, General Counsel for GCFA.
